Student NOTES from Institute juniors, not 'official'
Opening: Liberal Justices should 'rise above it'
and change their minds.
Segment#1: Steven Hayward writes for Powerline, as you know
We won't know about the vote until June, they know how they are going to vote. There won't be much of the discussion among the Justices, they write. This has been an amazing, incredible week.
Steven Hayward writes will and we interview him for the Limbaugh Letter. Who is it that is really smart, engaged; and who are we really up against. This week Liberals were exposed as abject frauds and not intellectually superior. They are not open-minded. Every question and point made by Samuel Clements and the good Justices, have been made for years.
Conservatism is no secret.
I am blown away by how Liberals were shocked out of their clothes. One was predicted it would be declared 'constitutional' and a slamdunk. So after 90 minutes of oral arguments, he predicts Obamacare is going down. They are over-hyped 'know-nothings', and in a prison of their own conceit and arrogance. They were confronted with Reality that they avoid. It hit them right between the eyes.
((Reading-Hayward: It is typical for a side to note the defects and weaknesses of their own side.)) That is what makes them unusual, they don't. There is no reason to feel inferior to these guys; the 'elites', are not. Verrilli is from what they consider 'Einstein' coming from the Columbia Law School and editor.
Verrilli was trying to defend what cannot be defended. Antonia Scalia asked the associate Solicitor General: "Do you really expect us to read and evaluate 2,700 pages of legalize?"
Elena Kagan should have recused herself; she defended Obama's Obamacare as it was being legislated.
The reality is that somebody is going to have to consult the 2,700 pages every time you go to the doctor. It would be your doctor or your insurance company. They will just defer to the government.
It is a boondoggle, outrage, and an absolute disaster.
Justice Kennedy said to Edwin Kneeler Associate Solicitor General, 'Rather than us go through it page by page, it makes more sense to get rid of the whole thing.'
Scalia said, "I'm not going to do it; and I'm not going to ask my clerks to." The Justices don't want to act as Congress making the laws.
>>> ED: The Justices will simply be voting on 'Constitutionality'.
>>>> Rush: Somebody will be making those decisions [about your life].
Seg#2: Stand up to phony attacks and you become stronger
I have so many people to thank; some saying yesterday was the best EIB program ever. We've posted DittoCam recordings on the free side of our website. We will also Tweet the link and put it up on our Facebook page.
Secondly, W-Post has a fair and correct recount of EIB last month.
The Left had a very bad month, and nothing that Liberals constructed was true. Every one (Flake, Phony-Boycott, Zimmerman) was not factual, appealing to their fringe base that has to be satisfied.
>>> Liberals do not, and cannot, survive in the Real World.
Rush Limbaugh promises to Tweet more good links, including DittoCam.
Seg#3: The Left is always angrier than average Americans
Ladies and gentlemen, what happened at the Supreme Court is profound. Many saw things for the first time. The next time media gets exercised in unity, just remember that there is no real outrage and they lie. Read the article of Steven Hayward. The country is never roiled as much as the Left is.
Just understand Liberals and don't believe them.
They have no moral core and are not as smart as you are. They have shut themselves off from learning. We learn about Liberalism but they have no interest in learning about Conservatism.
Little Tim Geithner said, "We don't have a plan; all we know is that we don't like yours. [Paul Ryan, et.al.]" He doesn't care; he is arrogant; and just that it is ours is enough for him to reject it.
More examples: ((Reading-UK-Daily-Mail: A teenager was found guilty of first degree murder of two Brits in Disney World.)) You will not see this in our media because it doesn't fit the template they have for the Trayvon case. "If I had a son, Trayvon is what he would look like", said Obama. They are both 17.
The DbM overhype is easy as heck to spot; don't get caught up in it. Another example: ((Reading-Politico: Moment of truth for Justice Roberts. Can he rise above politics?)) You can't be smarter than a Liberal. He should forget the reality that just happened this week and side with Obama.
Here is the lead from The New York Times ((Reading)) Why didn't blaming Verrilli work? Because he had something indefensible to defend. The Left will never admit their ideas are vacant. How long have they had to prepare?
Obamacare is the Utopian dream of Liberal/Progressives for 50 years, and they still can't defend it. 2,700 pages sitting in a drawer. All they can do is act as tyrants: "Do not examine our premise, just our good intentions."
Obama is not Black to me — he is a transformer of America. Same with Moochelle. I don't care what they look like. What is in their souls and minds is what matters to me.
They have 50 years and can't defend it. After ramming it down, they have had two years to prepare for this week. Now The NYTimes says it is Groobers fault, since blaming Verrilli didn't work. They will destroy anybody and anything to protect their blank ideas. They govern against the will of the people
That is why I am afraid for America; one man can save what hangs on a thread.
>>>>>>>> How did we ever get here ?
Rush asks (again) the obvious rhetorical question. [[Ans: Progressives]]
Seg#4: Constitution // Protection from takeover // Severability
The US Constitution is amazing. How is it that after 236 years it can still protect us from tyranny? The Left hates it for that very reason. It is a blessed document!
There is still silence on the illegal 'bounty' in Florida put on George Zimmerman. Obama spoke, assuming guilt. Spike Lee apologized for his tweet.
Elena Kagan will not recuse herself, but she should. I talked to a judge (eMail) who set me straight on the issue and rule of 'Severability'.
>>> I'm out of time now and will leave it as a 'tease'.
Because of media, it has not been explained properly.
Segment#5: Tax incentive/subsidy remains for US oil companies
More bad news for president Obama this morning:
>>> Obama's own Senate defeated his call to tax oil companies more.
Seg#6: The entire law must be stricken
(Theme Music) Why are they trying to charge the nutty captain for flight interference? Because he tried to get back into the cabin and interfere. 90% of cases end up in plea bargains. Most convictions come from plea bargains. The airline companies sell seats based on safety and need to punish those who make flights unsafe!
Insanity defense? The pilot did what he did! He terrorized the passengers and poised a great threat. It took four big guys to subdue him. Hell, I feel like running up and down the aisles with the news today. Obama is trying to bring us all down, but we are not going crazy. We try to stop The Regime.
'Severability' reporting is lacking. People confuse the rule. I thought that if Congress had put in a 'severability' clause in the law, then any item tossed out will not fall. Instead, the rule is whether or not Congress would have enacted the rest without the unconstitutional parts. Justice Scalia has picked up on this.
A severance part is missing in Obamacare; they affirmatively took it out, for whatever reason. Democrats took it out. Therefore, the entire law must be stricken, according to the letter-of-the-law. That is what my judge buddy explained, "There is no question about it!"
So what will happen, when politics trumps 'letter-of-the-law'? It could be 6-3 or 7-2 to strike the whole Obamacare if the Mandate falls. Democrats didn't stand behind the bill if a part of it were found to be unconstitutional.
So I eMailed back to confirm my understanding of the letter of the law. I doubt this all will happen. When reality sets in, the letter of the law will be moderated. My judge buddy replied, "Will these Justices really want to bring down the landmark work of the first Black president?"
They have lifetime appointments so they will be immune from political pressure.
Snerdley, the 'letter-of-the-law' depends on your alphabet.
>>> We are all human and interpretation always enters in.
Seg#7: 'Individual Responsibility Clause' is not a Republican plan !
It's like the NAA-L-CP, inserting 'Liberal'. The alphabet is important.
Caller: Pundits say 'Is the ruling good or bad for Obama?' What of Romney?
If other candidates stay in, Mitt Romney will have trouble getting to 1,144 delegates to gain the Nomination before Convention in August in Tampa FL. I remain neutral. Marco Rubio endorses Romney.
It's not yet etched in stone, with another Romney gaffe over his Dad used to close down factories in Michigan, (as he campaigns in Wisconsin.)
Caller-still: Could Romney differentiate since his didn't get struck down.
Sticking down the mandate would prove Romney's point, saying he would never do a national mandate, but leave it to the states. It's a stretch, but you are right. Romney people want to inoculate him from Obamacare: "He's right, you can have a state mandate, but not a national mandate."
Use the word "Illegal" above and beyond the word "unconstitutional".
Everything happens for a reason. This is teachable and a God-send. Just like the NAGs said "Rush is a gift to women". They didn't mean it.
Josh Earnest rebrands the 'Mandate' as a Republican plan for 'Individual Responsibility Clause', even though not one Republican voted for Obamacare.
>>> All of a sudden Libs believe in individual responsibility?
Josh Earnest is Deputy White House press Secretary
Seg#8: EIB is up 50% in a number of cities // Phony boycott failed !!
Statistics can be funny; but reality is that with our 600+ major stations, our ratings are up, from 10% to 60% depending on the station. We are up 50% in a number of places. Advertisers are going 'gang-busters'. Everybody is asking about it.
Caller: The NYTimes wants to blame. Are they going through the stages of grief?
Gregg Sargent has a DC website, far left. All of Liberalism is in denial, as a perpetual state, but in this case, Scalia said, "You expect us to go through 2,700 pages and determine what is constitutional?" What about judicial overreach?
The individual mandate is the funding and keystone of this bill.
As Justice Kennedy pointed out, it would change forever the relationship of government to the citizen, and citizen to government. It is all interconnected and it can't survive without requiring everyone to buy in.
Is his points that (1) Congress could not put it back together, and so (2) the Supreme Court will not strike it down? OK. That is patently absurd. Liberals are in a state of shock, they can't believe that anybody would disagree with Obamacare.
Have you ever wanted something so bad you could taste it? Zoran in Lord of the Rings was like that. This is them. Liberals do not understand the arguments against them. It is so beneath them to even listen.
Justices will decide if it is constitutional or not, based on [the alphabet].
Democrats think it will fire up their base; move directly to Single-Payer if the Mandate is struck down. They are not living in reality. How about this:
>>> Let's tax gas up to $8/gal and really excel Obama back to the WH.
Seg#9: Progressives want a world constitution to their liking
All of a sudden the Libs don't want the courts to do their jobs. Before, they wanted judicial activism. "It's too big for Congress to get it right, let it stand." How do you describe these people?
There isn't any alternative funding to Obamacare; no solar nor windmills.
Caller-VA: Four Conservatives + Four Libs + Kennedy; can't they rule?
Simple and piercing answer: Why don't they just read the Constitution and decide? The four on the Left want to throw out the Constitution.
It may be hard to accept, but the Libs want to redefine the Constitution to read as they want it. Then their wishes will be 'constitutional'. Some are put there as a reliable Liberal Democrat vote. Elena Kagan doesn't have the slightest idea of what she is doing. She was the Solicitor General while Obamacare was percolating.
Steven Breyer, Sotomayor, and Ginsburg are not there to find the truth and rule via the Constitution. They are just political Left votes. You think everybody likes America as founded and the Constitution.
>>> No, not with these Liberals on the Supreme Court.
Segment#10: There were a hundred ways to deal with healthcare.
>>> Obama/Pelosi/Reid chose the most preposterous, on purpose!
>>>>> It shows the total-incompetence of Obama/Pelosi/Reid !
Seg#11: The Father of George Zimmerman tells a very different story
(Music) The size of our audience in some cities has doubled, and so I repeat concepts for new ears tuning in. That's why I didn't get to soundbytes.
Obama kicked up his community organizing; trying to get a mob together to distract from obstructing the Keystone Pipeline and moratoriums on drilling. The Leftist ideas on the Left would lose without Drive-by Media. Barack Obama has to have an enemy to demonize: Big Oil, Walmart, Big Pharma (on their enemy list to impugn.) They will lie knowing DbM will echo.
There is not one point of the Obama presidency he can run on, point to, "You want four more years?" His only Hope is to make opponents look worse.
National Review Victor Davis Hansen points out how identity is important. If his name were Jorge Gutierrez rather than George Zimmerman ("White Hispanic") the drive-by media story would be different. His Father answers ((Clip-Dad: I never saw so much hate coming from the President, the Black Caucus of Congress, [etc] It is really unbelievable.)) George Zimmerman was a Democrat.
Look how shocked they are when they discover reality. There is a national hate fired up. ((Clip-Mr.Zimmerman: After getting his head off the concrete trying to keep his head from being [smashed] and over to the grass; at some point he gets out his gun; and the youth says, 'You are either going to die now or sometime tonight.' And he fights for his life.)) He is not a member of KKK.
The Duke lacrosse team was prejudged. The next time you see DbM, doubt it first. It is not Democrat vs Republican, not Black or White, it is Liberalism vs Conservatism. The view that Jesse Jackson and Al Sharpton wanted has not taken hold. They got away with it at first, but there are reasons to be optimistic.
Their effort failed, but they destroyed lives in the process.
>>> They don't care and will destroy whatever it takes.
Seg#12: What we have learned about using oil is miraculous
Gasoline prices have doubled under Obama and he wants them to double again. Nothing is working for his campaign, and so he goes back to his olde playbook. ((Clip-Obama: I am not worried about the big oil companies; carry their fair share.)) How will taxing them more help you? It won't.
The free flow of oil is the driving force in our market economy. It is a blatant lie about subsidies. They have tax breaks to encourage more supply and cheaper prices. They pay $0.40 tax on every dollar they earn. Apple pays $0.20 for each dollar they earn.
The Senate Democrats rejected Obama on this. ((Clip-Obama: We should be investing in sun, wind, [etc].)) We did and it didn't work. ((Clip-Obama: Congress can vote to spend billions of dollars trapped in the past.)) There is no current alternative that will get an airplane off the ground. Oil is also natural.
>>> What we have learned about oil and its uses is miraculous.
Senate Democrats voted Obama down.
Seg#13: Will tossing Mandate usher in Single-Payer Medicare ?
Caller-NV: Duke lacrosse team was victimized. Democrats won.
That election was based on another lie about Mark Foley. He didn't touch anybody, and Democrats saved that for their October Surprise.
The bounty on George Zimmerman is still out there, but the story that harms Republicans as intended won't happen. The Independents don't want to support Democrats when they don't speak out against bounties. Their plans have been to (1) intimidate; and (2) make people shut up.
A lie spread around the world instantly; Truth takes years to catch up.
You will right, they will get the Far-Left and Black votes, nothing more.
Caller: Severability is revealing, left out by Congress, daring Justices.
Your thinking is Supreme Court will have to support it all. No, I think they were in a hurry, not that smart, and politically devious. They dreamed about this for 50 years. Ezekiel is a doctor, MD, PhD, and the ballet dancer's brother, Rahm Emanuel. ((Clip-Ezekiel: That, I believe, was an oversight. All the lower courts understood it was severable. It isn't the role of Justices to decide the structure. Seems to be usurping from Congress.)) Scalia specifically said they won't do that. This is hilarious!
They are diabolical and not as smart as you give them credit for: They would gladly get the nose of the camel under the tent.
>>> Other pundits say, "They would rather get Single-Payer now".
Seg#14: Consider the threat made by Trayvon Williams
Obama wants to eliminate fostering oil exploration, but subsidizes Brazil, the Muslim Brotherhood, big unions, environmental groups. They want to 'redistribute' your wealth. Big Government uses food stamps.
"You're going to die tonight" was a threat to George Zimmerman; and a witness says Trayvon Williams went for the gun of Zimmerman.
>>> DbM is not highlighting new revelations; it is not going away.
Seg#15: Is there bias in Mainstream Media ? Is there any doubt?
LaRaza dismisses George Zimmerman and questions his ethnicity. Why?
>>> [ED: Is it because Drive-by Media called him "White Hispanic"?]
Closing: See you tomorrow.

From the Rush Limbaugh Morning Update: "A Promise"
January 2008, candidate Obama promised he would put a cap-and-trade system in place that is as aggressive, if not more aggressive than anybody else's out there.
He said, "If somebody wants to build a coal-powered plant, they can; it's just that it will bankrupt them, because they're going to be charged a huge amount of money for all that greenhouse gas that's being emitted. That will also generate billions of dollars that we can invest in solar, wind, biodiesel, and other alternative energy approaches. Electricity rates would necessarily skyrocket."
This week, Obama's EPA proposed new regulations to ban the building of new coal-powered plants, unless the owners install punitively expensive equipment to further lower greenhouse gas emissions.
Promise kept. Obama and his henchmen are doing their level best to bankrupt the coal industry now.
His attempt to impose cap-and-trade, to bankrupt a large part of our economy, was so egregious that it never even made it through the Democrat Senate. But Obama did, as he also promised, spend billions on solar and other alternative energy like algae. By investing in companies linked to his campaign donors many went belly up, costing taxpayers a lot of money, billions.
This is why radical environmentalists love Obama. He killed the Keystone pipeline, while after it says he authorized it. He's bankrupting the coal industry. He is as anti-American energy person as there is. And he keeps his promises to the environmentalists.

Quote Gems from Rush Limbaugh dot com:
"If we're not careful, we are going to lose this country. We are going to shred the Constitution in ways that it can't be put back together."
"We have this legislative debacle -- this monstrosity, this worthless piece of legislation -- that is going to rip the fiber out of this country. All for 15 million people who have chosen not to have health insurance!"
"I just marvel at all of these legal minds on the left -- be they network experts, law professors, or whatever -- who, up until yesterday, apparently never even considered the possibility that the individual mandate in the commerce clause is unconstitutional."
"I try to distance myself from it and try to not succumb and get caught up in the daily narrative and template of whatever the issue is that's being discussed."
"It is paramountly obvious that the so-called smartest people among us are not even C students in life. They're not even C students in getting up and making things work. And our side engages them as though they're smarter than we are, and we have to impress them. And I'm talking about the intellectual elites on our side."
"If the judges throw out the mandate but leave enough of the law in, the Democrats who run Congress -- if they are still going to run it -- are going to have a simple solution to this: Medicare for everybody!"
"We are up against the forces of tyranny. And when the forces of tyranny start tasting this power, then anybody who opposes them has become an enemy who must be silenced, must be shut down. And how? With the full force of government!"
"It's no wonder that the Democrats block voter ID laws and push for legislation allowing felons the right to vote because they know if the election were held today, he doesn't stand much of a chance. Nobody will tell you that. I will."
"We have lost two million jobs since Obama was inaugurated. I don't care how many they claim they're adding week to week. We have lost two million jobs, and we have not replaced them. We're at a net negative situation, and it's not changing."
"In Realville, where real people live, the Supreme Court has just said: Obamacare is illegal. That's what 'unconstitutional' means. It's illegal. They want to try to spin that as a positive? Let 'em try!"
"I love it when presidents are told by courts that the things they believe in are illegal, coupled with all their other failures. Yeah, I love people who also see that as a road to victory. Yeah, the next thing they're going to tell us is this was Obama's grand strategy: To fail at everything but make a great effort at it."
"The Democrat Party has been governing against the will of the people since Obama set foot in the Oval Office."
"The more it unfolds here, the more obvious it becomes to me that this ought to be one of the biggest embarrassments in this nation's history. This whole episode. This whole law. This whole piece of legislation. This whole effort to ram it through. Its premise, its objective. Plus it's tragic."
"This isn't any education that goes on. There's no learning that happens in liberalism. Indoctrination and propagandizing is what happens. It's inculcation, not learning, not critical thinking."
"The 'constitutional awakening' is the Tea Party. The Tea Party was the 'constitutional awakening' in 2009 and 2010. The Tea Party voting in the midterms in 2010, that's the 'constitutional awakening.'"
"We haven't lost any audience in this program. The audience is larger than it's ever been. The people who have been hurt on this program are the advertisers who left!"
"You take a look at any city dominated by liberalism for a long period of time, unchecked, and you will see major problems."

BONUS: Learned from Mark Levin (radio) [a legal beagle!]
Chief Justice John Roberts is a Constitutionalist/Originalist. They take the oath to uphold the American Constitution, not foreign nations, not living-and-breathing docs. Some justices see their job properly, and some don't. It's up to Congress to do any 'salvage' job, within their bounds, of course. What are the Liberals thinking? ((Clip-Verrilli)) ((Clip-Alito: "Where is the sharp line? I don't see it."))
((Clip-Scalia: Can you take out the heart of the act and leave the act?)) ((Clip-Verrilli babbling.)) Justices are saying they hold up to the Constitution.
The individual mandate is something Congress has never, ever, done before. Justices should determine it is unconstitutional and their job is then done. Other aspects of the stature have not been litigated.
The last Congress that passed this abomination is gone! Liberal clingers.
BONUS: Learned from Sean Hannity (radio)
I spent an hour and a half this morning on Twitter; fire out some tweets. Governor Mitt Romney will be at the top of the hour, with a secret meeting with Gingrich to maybe report. Watch TV tonight, media so wrong. You see the dramatic Trayvon story-line shift and I said, "Don't rush to judgment."
The Liberal Left looks for just one word to attack on the Right, and ignore hate speech on the Left, like Bill Maher. Obama spoke too soon. From 'day one' there has been a witness saying Trayvon was beating up on George Zimmerman, and it was reported since day one.
