Seg#1: Justice Roberts perpetrated a fraud and a travesty
I am literally sick over what happened; there is no other way to describe it.
I've had time to think about the GIANT HORRIBLE FRAUD perpetrated on the American people. There are now no limits on Big Government and what they control. And John Roberts knew this. The Supreme Court as an institution is forever tarnished.
There is no way that this law even approaches constitutionality.
With our eyes wide open, we were defrauded and laughed at. They mocked us. By the way, I can't take much more reading the faint praise for Justice Roberts. I understand the theory of taking the best of what you can. But this is theft right before our eyes. It is even worse than theft, taxing for what we don't buy.
It's like going into a grocery store, "No, I don't want to buy any gum." . . . "OK, that will be $2." Michelle Obama notes that Abortion is now free. There is a list of free stuff, for a couple of years.
Everyone knew it was unconstitutional, except the four liberals on the court. So Justice Roberts rewrote the legislation in a way no one ever intended, to get it passed. It starts a universe of lack-of-activity that can be taxed.
A bunch of Liberals are ticked off at Roberts because of what he did with the Commerce Clause. That is why Buzzy Ginsberg wrote a dissent. Roberts contended the mandate was unconstitutional but it could be upheld if considered a tax. Ginsberg says if you go that rate, you don't even have to get to the mandate. Libs were ticked off at Roberts answering an unasked question.
All of this is total BS gobbledegook. I'll explain more. Obama/Liberal/Democrats insisted up-and-down that this was not a tax on everyone. They relied on the Commerce Clause. It is a travesty for a judge to decide it is up to him to redefine legislation. We can't count on the Supreme Court to uphold the Constitution. We have pure fraud right before our very eyes.
Byron York wrote about the ruling and you will be more angry than you really are. In oral argument the court allowed arguing both sides, a tax or not a tax.

Seg#2: The Supreme Court failed in their job to uphold the Constitution
This case was presented as stretching the commerce clause to allow the government to dictate what you can and cannot buy. That is how Congress made it and presented it to the public. Why did no one think of this approach? Because we are constrained by law. The court rewrote the bill!
We know Congress tried to perpetrate a fraud with the commerce clause to force people to buy what they didn't want; but now the Supreme Court also. The Supreme Court has found 169 times something was unconstitutional, it is their job. It is not their job to find a new way to make something constitutional.

Seg#3: The court allowed the government lawyer to argue both sides
I understand it is a GOP fund-raising opportunity, but for crying out loud! Every poll under the sun shows the people do not want this bill, some by a ratio of three to one. Mitt Romney boosted fundraising by $4million and he didn't even ask for it.
There is nowhere to go when Congress passes unconstitutional Liberal measures that don't work. ((Reading Byron York: The first question the Justices had was, "It this a tax?" It can't be challenged until 2014 until someone pays. Government lawyers said "No, it's not a tax.")) That was March 26th. The government would not say it was a tax, so the court went out and hired a lawyer to argue that it was a tax, Robert Long.
After Robert Long made the case, the government argued that it was not. That is what happened on the first day of oral arguments. Justice Alito saw the conflict right away. It sounded boring at the time. The first day is where the fraud happened: If you don't like the commerce cause it could be a tax. ((Reading on: Roberts joined the four Liberals who would not give it up under any conditions.)) True.
((Reading on)) From the get-go this case was allowed to be sloppy, shaped, molded, and any way the Liberals wanted it to be. The court rules the commerce cause is not good for Obamacare, but does not limit the commerce clause tax increase for other things. The government gets the money.
The money will go to insurance companies and fines to government.

Seg#6: Justice Roberts didn't make sure the AZ legislation sticked
(Theme Music) Quick Question: You have to go outside the bounds of the Constitution to find Obamacare legal? NYTimes reports Roberts saying, "I've got to save the act." Excuse me?
Justice Roberts quotes Justice Oliver Wendell Holmes, "As between two possible consequences, our plain duty is to save the act." How did that work in your Arizona finding? It's almost like, "If you can imagine it might be constitution, make it so." It's insane!
Truly, it is not fair to make it hard to rob your house, so we'll help. Harry Reid took a House bill, gutted it, and put Obamacare in its place. Supreme Court goes along. We have no place to go.
Did Justice Roberts go out of his way to find the AZ laws (mirroring the federal laws) and the court said, "You can't." They are not consistent. Both cases were 'legislation by representatives of the people.'
Snerdley asks if there is a glimmer of Hope. Yes, we have to wrap this around Obama's head [turban?] as tightly as we can. Free stuff? Vaccination for kids; insurance even with existing problems. Moochelle-my-belle notes that 'contraception' is now free.
So what do we have to do? Start all over. By design, death panels won't start until 2014; tax increase happens in 2014, long after election 2012. Costs start now but paying starts two years later. The glimmer of hope is winning the White House and the Senate, holding the House. What do you see, Snerdley? This is worse than a socialist banana country!
I suppose Romney could just ignore Obamacare. Obama just ignores, like granting illegals amnesty and gets away with it. Romney could just say Obamacare doesn't exist. I'm being facetious.
The court says you can tell anybody you won four purple hearts. As long as you don't make money, that is perfectly fine. You might ask if you can lie to grand juries about having sex with grand juries. And before the Supreme Court, you could answer one way one day and the opposite the next.

Segment#7: Moochelle/Obama want a 'Single-Payer' Marxist nation
The Regime threatened to rescind the Military allotment because Congress did not include increases for military personnel to pay more for healthcare. Why would that be? To force soldiers/families to sign up for Obamacare, which will be cheaper than TriCare, for now. They want 'Single Payer'.
The government doesn't have to make a profit, so they can undercut every other provider for two years. Don't doubt me: you will not be able to keep your plan and doctors after they all leave the business.
Caller: Obama will say this: He never said it would be a tax.
Republicans have to force Obama to say what it is. Obama will stick with how everything is free. Who will make him say it? If Romney points it out, Drive-by Media will stand with Obama.
Everybody wants to find the gift in this. I understand. I'm looking at America.

Seg#8: Chief Justice Roberts provided the Mother of all Activism
If the Chief Justice of the Supreme Court says he will do whatever it takes to make sure the act survives then it is this: the court job to find what is against the law OK. So why do we need a Supreme Court?
Talk about activism! Justice Roberts is extreme. Marberry vs Madison is when the court assigned to itself the role of determining what is passed by Congress is constitutional or not. This is the Mother of all Activism.
Caller: People were prosecuted under the sedition act, reversed in 1920.

All the pundits say, "Nobody predicted this; Justice Roberts is so smart."
Sorry, but there isn't brilliance here. Nobody tried breaking the Constitution.
I don't think we will ever know what happened to Roberts, if anything.

Four Libs voted for Obamacare no matter what. The other four were against it: Kennedy, Alito, Scalia, Thomas. So then John Roberts sides with the Liberals and assigns to himself to write the 'majority report'. The Liberals didn't like him deciding on a tax basis; [Buzzy] Ginsberg didn't like not including the commerce clause and writes a dissent.
She was ticked: "Don't even mention the commerce clause; leave it alone so we can use it later for things Libs like."
One guy found the mechanism how to make it constitutional; he had
four Liberals voting with him. The four Liberals didn't like how he did it.

Seg#9: Constitution does not permit Obamacare forced payment
www.landmarklegal.org Smart people at Landmarks Foundation anticipated where this might go. ((Reading)) They filed a brief, "You can't call Obamacare a tax under the Constitution." Think of all the federal taxes you can think of: fees, and income tax per Constitutional amendment 16. That's it. This tax is not permitted under the Constitution. You have to buy healthcare insurance under Obamacare, and the fee is paid to insurance companies. Didn't matter.
For there to be an income tax, there had to be an amendment to the Constitution; and for Obamacare, no change to the Constitution was made; Obamacare just goes around.

Segment#11: With voting, we the people get what we really want
(Music) Let's torture ourselves and listen to Liberal analysis. This is not a faculty-lounge debate between intellectuals. People in this audience, those who make this nation work, are not interested in all small details — they just want to see the Supreme Court uphold the Constitution and help defend their freedom.
Over on the side you can applaud that the commerce clause was not stretched. But we were not saved under the Constitution. I'm just a common man blessed with uncredible good fortune. Every person should pursue excellence to the level they wish and reap benefits. For that to happen, the premise of America has to be upheld.
It is up to us, in the next election, to reassert our wishes, for ourselves, next generations, and our pets. People always get what they want. Are we still a country that believes in hard work and not relying on others? I take building America personally.
I don't support elitists who think they are better than everyone else. I look at the decision yesterday as a huge impediment, and also as people not seeing freedom and liberty as I do. That is why I am disquieted. The task becomes harder. I am not in denial but it was all so unnecessary.
It comes down to Right vs Wrong. We don't always listen to the still-small-voice, but we all know. Then we find out who doesn't care; they are interested in, "Wow, isn't Roberts brilliant?"
Slate.com editor Jessica Grose was on with Blitzer and their 100,000 viewers (Clip-her: This was a mark of true statesman and he fell on his sword for the integrity of the court.)) It is only because she got the outcome she wanted.
Tom Brokaw admitted he didn't know details about Obama when he went to the Oval Office, and now says ((Clip-Brokaw: Yes, we are surprised. It lowers the temperature of the debate.)) [Rush laughs.]
Somebody shamed Obama into going to fires in Colorado. Bush was criticized for not landing (taking resources when everyone stops for him.) Will they criticize Obama when he just flys over on the way to California for fundraising.

There is a minimum of 21 new tax increases, like when you are self-employed.

Seg#13: What a justice says in passing does not set precedence
It's a whole new world for taxation. Liberals don't need to hide behind the Commerce Clause anymore. They can tax anything they want.
Alan Keys says, "How would Nancy Pelosi feel if government mandates that everyone just buy a hand gun or pay a fine?" That could happen when Republicans take back power. Pelosi said she doesn't see anything wrong with putting people who don't pay up in jail.
Death panels and a pecking order could be applied per who you voted for.
Caller: Prior caller got it wrong. Liberals will want to avoid 'tax' discussion.
Caller: Nothing will stop precedence – but Dictum is not Precedence.
That's a good point! Smart legal-beagles are missing that point.

I've intended to strip it all away and be honest with you. Be positive. There is no victory here—we didn't win anything.
Drudge has a note: Wiretap angle on Fast and Furious. Has to be approved by a judge, and you must say what you are doing. They have to be approved by DoJ before they are submitted to a judge.
That puts the lie to "Eric Holder and DoJ officials didn't know." It is very likely that Holder knew and hides it from Darrell Issa. Everyone is trying to click on that link and brings down the server. [Now even more.]

News from the People's Republic of Maryland. The Montgomery County Board of Education just voted to ban nonprofit groups from distributing fliers to middle and high school students. This, in the wake of protests about leaflets that were handed out last February. A group calling itself Parents and Friends of Ex-Gays and Gays distributed material that implied homosexuality could be changed.
Superintendent Joshua Starr and some parents called that message intolerant. So, in the name of tolerance, from now on no one but government agencies and PTAs will be allowed to hand out leaflets to schoolkids in Montgomery County.
Banning speech is the sole way to ensure the students in Maryland learn what America's all about. Only the government and a government-approved association have the right to express their opinions to "the children." No other opinions, thoughts, expression of ideas, dreams, aspirations, or beliefs will be tolerated, under any circumstances.
Perhaps it's time to go further in the struggle to save the children. The Montgomery County Board of Education might consider collecting all reading materials that could be deemed politically unsuitable for middle or high school students. Books with officially-frowned-upon content, which might fall into the hands of students, could be burned by Board of Education members, wearing their state-approved brown shirts.
We must ensure that Montgomery County students are never exposed to ideas the Board of Education doesn't like. After all, isn't that what freedom is all about?
