Seg#1: What are your insights on the Mandate vote tomorrow?
They predict Chief Justice John Roberts will vote at least to remove individual mandates from Obamacare and break a 4-4 tie tomorrow. A lot of people stick their necks out to predict.
The focus of The New York Times is to berate "smartest people ever to be in the White House" and didn't realize the mandate was unconstitutional and didn't take care of that. Some see Obama acting depressed, but could set up a victory.
I don't care what anybody else thinks—that is one reason I don't have guests.
Another reason is to distinguish myself from other hosts; It is better to research myself and report The Truth rather than host special interests. Today, I'll ask you your opinions on what is going on and the coming ruling. Snerdley sends me a note that in oral arguments that The Wise Latina (Sotomayor) that she was telling the other justices that the mandate was unconstitutional.
If the mandate goes, so goes the funding. It was scored that way. It is how The Regime kept the projected cost under $1Trillion (said to be the cost of the Iraq War). The Mandate is the brain and the heart of this monstrosity.
Another Question: What are Republicans going to do if Mandate is torpedoed? Will they say it was unconstitutional or will they say, 'Families want their kids covered.' "To Hell with Conservatism, I want it." This is what it comes down to.
All the Anti Big Government stuff goes out the window when it is personal.
House Speaker Boehner was calling a lot of people, including me, and their position is to repel as much as they can, not repel-and-replace, but REPEAL!
Then you remember that the 2012 Election is in four months, and Obama will say, "Four White guys and a Black uncle tom took away your healthcare." If we are going bring commonsense reforms, we have to fight for them.
In early arguments, Justice Kennedy was against Obamacare, but later, when alternatives came up, he listened and can go either way based on oral arguments. Sotomayor made a point about constitutionality.
((Clip-Obama: [Praising Miami Heat].)) Does he really not know that the name of the NBA 2012 champions is not the Miami Heat? He insults them. When talking about McCain he would only scratch his face with his middle-finger.

Seg#3: Is David Brooks smarter than a fifth grader and you?
DNC hired a bunch of people, idiots who didn't even know about Karl Rove. ((Clip-Montage: I don't like the guy; everything with Obama was going great. He wants to be president but we need Obama as president.)) Sounds like the people from Detroit that thought Obama was passing out money.
Have you heard of L. Z. Granderson? I had not. He is now the Journalist of the Year, so named by Lesbians, GAYs, and Transgenders. He writes that we should butt out of Fast & Furious. "The people killed in the operation are just collateral damage. It is none of our business."
David Brooks writes that we have to relearn how to be good followers. Put that together with "It is none of our business" so just follow. He says that we are in trouble because we don't follow smart people like Obama. "If we hold that we are all equal, it is hard to recognize the brightest among us."
When you combine that with his theme that we are all a bunch of nobodies, it's no wonder the leaders have troubles when they are stupid. Authority Brooks is also rejected and he doesn't like it.

Segment#4: Rush Limbaugh illustrates by being absurd
President Kardashian is not good for Democrats. And if he is not good for Democrats, how can Democrats argue Obama is good for America? Claire McCaskill and eight other prominent Democrats announce they will not attend the convention in Charlotte NC. Democrats running for reelection are told to stay away: Steve Israel is top guy of the Democrat Congressional Campaign Committee.
Have you noticed that all nine Democrats boycotting the convention, with their pictures, they are all White? There is a White Democrat protest of the First Black President, including White women. They are getting nowhere near the convention for Obama.
Steve Israel wants them to segregate themselves. Expect 4,000 at the convention. Even during the Nixon era people were not dissuaded. And the convention was cut from four days to three days by not going to celebrate at the racetrack.

They are told to stay away from the Democrat National Convention.

Seg#6: Young adults notice and live the effects of the national debt
(Theme Music) Others advise Democrats not to attend convention.
London Professor Haslett helped me tour London and Parliament. I interviewed one who had to get back to his 'constituency' — he meant his home.
And they didn't want to get near the race track, so it is scratched. Republicans meet August 27-30 and Democrats follow in September 4-6.
Utah Democrat Jim Matheson will vote to hold Eric Holder in contempt of Congress; and he is a White guy voting against the Black attorney general for Obama.
Dick Morris writes about Obama's failed presidency. Remember my WSJ opEd, "I hope he fails", mischaracterized. ((Reading: Individual Mandate is at the heart of Obama's signature movement. Rejecting it will show a failed presidency.))
Young adults are devastated and say they don't have the money to get married and live a normal, traditional life. Normally, young adults do not notice the national debt. But now, Democrats are pushing for more debt.
iPhone, and other smart-phone App developers are encountering limits of regulations. Young people are learning the blocks. It matters.
What if Obama proposes forgiving mortgage debt of wiping student loans off the books. He doesn't have to actually do it—just announce an October surprise.
But young people are finding out about Obama policy. How many young people are depressed and disappointed that life after college is not as seen on TV shows. Don't be so fast to surrender the Hispanic and Youth vote to Obama.
Back to Morris ((Reading: Stimulus didn't work; didn't create jobs.)) If it were so great, why didn't Congress go for another. And Biden doesn't want to be called 'middleclass'. ((Clip-yesterday: I don't live a middleclass anymore; I live in a beautiful home and fly around.)) He means that he is not like us.
Can you imagine a Republican running around and talking this way?
((Clip-Biden: Bain & Romney made a lot of money, in Singapore.)) He sounds jealous. Biden creates a new term, 'off-shoring' because Obama doesn't know what 'out-sourcing' is.

Seg#7: There are two aspects of anti-injunction against the states
Caller: I'm concerned about 'anti-injunction' (prevent states from challenging.)
There will be no need to challenge what is not there (if removed).

Seg#8: Romney camp wants a retraction from the Washington Post
We were talking about 'the tax levy' anti-injunction aspect. The other aspect is about states not being able to challenge federal actions. It won't matter.
Whatever the ruling is, there will be an election in 2012. Buck up!
I have not joined the chorus predicting — because I don't know. There is even a theory that Obama is 'acting' depressed to when it passes OK, we will be really depressed and give up. They second-guess, squared.
Within literally minutes, Obama had Big Sis stick it to AZ, which lead some to say he was tipped off. People don't know. If Mandate goes, paying for Obamacare goes. If you get elated, you will get depressed when Obama blames White guys and DbM stands with him. They already know how they will spin for a 'win' for Obama. There are complicating factors and people don't know.
"A loss for Obama will help him in his campaign." No, the Democrat base is not fired up and Obama is having trouble raising money. Turn it around and ask, "If Mandate is found to be constitutional, will you fire up for Romney?" Many of you will work harder.
Democrats/DbM are just talking to themselves. Even they believe the Mandate is gone. Upholding Obamacare would galvanize The Tea Party. Intrade had Obamacare going down by 71%.
If the DbM were not depressed over the vote tomorrow they would not be covering Liberal Nora Ephron dying all day. I sat by her once at dinner and she was very nice. She wanted to know how to be successful in the book marketplace. She was also funny and as described today:
Obama literally doesn't know that 'outsourcing' jobs is, so they come up with the term, 'out-shoring'. At 2pm today at W-Post Romney will show them their inaccuracies. Glen Kessler of W-Post gives his own paper '4-pinoccios' and Romney camp wants a retraction.
Caller-old-guy: Supreme Court miss three of four with AZ. Depend on people.

How does the Democrat candidate always get over 90% of their vote?
Caller-still: Ron Brown got as high as anybody in the Democrat structure. Romney did better putting in Colin Powell and Condi Rice. A president has to have the vision of a shining city on a hill.
Could anyone have beaten Obama w/DbM much less McCain?
Speaking of Rev Al Sharpton, he says he has secret actions planned to counter the contempt vote against Eric Holder.

Seg#12: Can you imagine the VP debate for the 2012 election?
Obama's Vice-president, Joe "not middleclass" Biden, is out there saying America is in a depression. I'm sure Obama likes that! Then he plagiarizes Reagan's line. But he leaves out the punchline: "Recovery is when Carter lose his job." You people in Iowa, keep asking Biden questions. Ask Biden if Obama knows what the vote tomorrow is about.
Caller-gal: Doesn't Obamacare have a 'severability' clause?
Liberal Democrats forgot to put it in, it is stand-or-fall. Scalia mocked the government lawyer, "What do you want us to do, write your bill line-by-line." Some thought it was intentional — acting over-confident. They can't rule on just part of Obamacare.
Even there is no severability in there, the court could rule to toss part and keep the rest. But without the Mandate, there is no funding mechanism.
If President can choose which laws to obey, like with 8-1 vote for AZ, then why pay taxes?

Seg#13: Americans would not like losing liberty to Individual Mandate
Remember federal judge Roger Vincent? Back in January 2011, he ruled that the Individual Mandate violated the commerce clause of the Constitution. As the mandate is not 'severable' he ruled the whole thing is unconstitutional.
Other federal judges have ruled differently and that is why it ends up at the Supreme Court. It is unusual that no one (not even myself) talked about it.
((Clip-Biden: When your neighbor loses his job it is a recession, etc.)) I'm convinced Middleclass Joe is convince Obama wants to toss him. "You choose another running mate, and there is more of this coming in my arsenal."
Caller: Mandate will go down in flames; if it does not, Americans do not like being dictated to. You will see a reaction at the polls.
Initially, some may throw their hands up. I hope your are right and I continue to believe in the American people. They have an underground entry to their chambers and we don't even know when they are there.
Caller-gal: Obamacare still leaves some people uninsured, right?
Yes. The number of Americans that want it and don't have it is between 10 to 20million. They are young and want money for TV screens. We are doing all of this for the cost of the food stamp program. The bill is not about healthcare but Big Gov't and dictating your behavior. It is about dictatorial control over people's lives.
Caller: To Libs, you and Tea Party are mysteries.
They try to discredit Tea Party when they are scared. We started broadcasting in 1988 and validated the views people already had.

Seg#14: Rush empathizes with Stockton CA firemen as reality sets in
Patrick Kennedy, son of the late Ted Kennedy, says that if Obamacare is found constitutional, the Tea Party radicals will go on a rampage (it is a fund raiser eMail note.) "Dangerous Tea Party extremists will go on a rampage!"
He may have a point (not rampage) but there will be Hell-to-pay in Nov.
Stockton CA files for bankruptcy, a real shame. $157,000/yr for each firefighter. They can retire at age 50 with lifetime benefits up to 90%. The deals should never been made. The money just isn't there; it was never sustainable.

It won't get the attention the Obamacare ruling will. But the Supreme Court's June 25 reaffirmation of its Citizens United decision will upset liberals for a long time to come.
In an unsigned decision, the Court ruled 5-4 that Montana's campaign finance laws, which banned corporate campaign spending, was in conflict with the 2010 Citizens United ruling.
The Montana Supreme Court had refused to strike down a 100-year-old ban on corporations' election spending. As justification, they cited instances when legislators had been bribed by corporate figures. But the Supreme Court didn't even bother to take oral arguments. It just slapped the Montana court, legally speaking, and reminded them who is in charge.
Liberals hate the Citizens United ruling because it helps level the playing field. Before, unions could spend without limits, and the state-controlled media could advocate for Democrats, while corporations couldn't participate in elections at all. That, despite the hardships imposed on them by liberals. Now corporations can "vote" with their pocketbooks, like everyone else.
You remember the State of the Union show, when Obama voiced liberals' frustrations, attacking the Supreme Court as its members sat before him, castigating their Citizens United ruling. It was tacky, rude, classless. But ultimately, it didn't matter.
The Supreme Court just told Obama, Montana, and every other liberal still whining about Citizens United, to stick it where the sun don't shine. The law's the law. Corporations are people too!

(1) He pointed out that he supports Conservative concepts;
(2) He played both sides by criticizing his opponent as Tea Party;
